UY! LISTING KO YAN!!! (Hey! That’s my listing!)

In the industry, we often hear the phrase “Hey! That’s my listing!” from many so-called freelance, bogus, unlicensed, unaccredited illegal real estate agents.

Many so-called freelance agents believe that when they pointed out certain house, building, condo, apartment or land, those properties are already their listings!

Wow, that’s really convenient isn’t it? Hence, I’m gonna point out all lands and improvements in all of the Philippines! Does that mean any real property sold or leased in the Philippines is my listing?

WHAT IS A REAL ESTATE LISTING?

Document Signature

•       IT IS A WRITTEN AUTHORITY GIVEN BY THE OWNER TO THE BROKER TO OFFER TO SELL, LEASE, MORTGAGE, EXCHANGE OR JOINT VENTURE, HIS/HER PROPERTY OR THE PROPERTY AUTHORIZED TO HIM BY THE REGISTERED OWNER BY VIRTUE OF SPECIAL POWER OF ATTORNEY, FOR A COMMISSION, FEE, AND/OR VALUEBLE CONSIDERATION.

3 KINDS OF LISTINGS

•       EXCLUSIVE AUTHORITY– Gives the greatest protection to the broker because even if the owner sold or lease his/her own property, the broker is entitled to a professional fee. No other person shall sell/lease the property but the authorized broker.

•       EXCLUSIVE AGENCY RIGHTS – The broker is not entitled to a commission if the owner sell/lease his/her own property. No other agent shall sell/lease the property but the owner or the authorized broker.

•       NON-EXCLUSIVE- Any licensed broker or the owner can sell/lease the property. Whoever sell/lease it first shall be entitled to a professional fee.

Therefore IF A PERSON HAS NO AUTHORITY TO SELL OR LEASE, THEN HE HAS NO LISTING!

It is very important that an agent is legally authorized by the registered owner or authorized seller/landlord, in writing form to offer the property to sell or lease, for the protection and security of both the agent and the property owner/landlord/authorized seller. Otherwise, there may be legal implications in offering, publishing and marketing to the public these properties for sale/lease without written authority.

CAN A REAL ESTATE SALESPERSON/AGENT GET A LISTING IN HIS/HER NAME?

Let’s look at what the law tells us…

RIGHTS AND LIMITATIONS OF A SALESPERSON :

•       Can perform Real Estate Services for and in behalf, and under direct Supervision of a licensed Real Estate broker.-

‘’RESA Sec.31 Paragraph 1 Sentence 4’’

•       As such they cannot by themselves be assignatory to a written agreement involving a real estate transaction unless the real estate broker who has direct supervision and accountability over them is also a signatory thereto. – ‘’RESA Sec.31 Paragraph 1 Sentence 5’’

•       No real estate salesperson, either directly or indirectly negotiate or transact any real estate transaction for and in behalf of a real estate broker without first securing an authorized accreditation as real estate salesperson for the real estate broker, as prescribed by the Board.

‘’RESA Sec.31 Paragraph 1 Sentence 6’’

The law clearly tells us that no salesperson can directly or indirectly transact any real estate transactions and cannot be a principal assignatory to any document involving real estate transaction including an AUTHORITY TO SELL. But a salesperson can affix his/her signature as witness as long as his/her supervising licensed broker signs as principal assignatory in the same document. Therefore, what a salesperson can do is ENDORSE THE LISTING to his/her supervising licensed broker.

Do not just point out properties, endorse listings PROPERLY!

HOW TO ENDORSE LISTINGS?

•       CHECK YOUR SOCIAL NETWORK.

•       WATCH OUT FOR ADVERTISEMENT BY THE OWNER OR SIGNS ON PROPERTIES.

•       SOURCE OUT PROPERTIES FOR SALE OR LEASE, ETC. THROUGH TAX MAPPING.

•       GET CONTACT NUMBERS AND INFORMATION.

•       CALL AND OFFER OUR SERVICES IN A PROFESSIONAL MANNER.

•       SET UP AN APPOINTMENT TO MEET AND TAKE PICTURES OF THE PROPERTY.

•       ASK COPIES OF PROPERTY DOCUMENTS AND OWNER’S/REPRESENTATIVES IDENTIFICATION AND/OR S.P.A.

•       FILL-UP THE AUTHORITY TO SELL/LEASE FORM , GET COMPLETE DETAILS, INFORMATION, AND HAVE THE OWNER/REPRESENTATIVE SIGN IT.

•       PUT THE DOCUMENTS AND SIGNED AUTHORITY IN AN ENVELOPE

•       LOG ALL IMPORTANT PROPERTY INFORMATION, NAMES, ADDRESSES, CONTACT DETAILS, DATES AND FILE-NAMES IN YOUR AGENTS’ PERSONAL LOG-BOOK.

•       ENDORSE THE LISTING TO THE ACCREDITING BROKER FOR SIGNING.

•       HAVE THE PICTURES UPLOADED IN THE COMPUTER.

 

CHECK YOUR SOCIAL NETWORK

                Find out who amongst your friends, family, relatives, classmates, former clients, acquaintances, neighbor, facebook list, twitter friends, forums, social clubs, civic organizations, work mates, enemies, ex-boyfriend/girlfriend, ex-spouse, mistress, in-laws, cohorts, etc. about properties for sale or lease.

You can also search people who are selling or leasing-out their properties in classified ads, internet, newspapers, magazines, etc.

 

TAX MAPPING

                One of your services is to map out registered owners of certain properties in Angeles City and Pampanga through Tax Mapping. Our agents are accredited to many government offices in different municipalities and City Halls in the area. Please contact us to avail of this service.

CALL AND ARRANGE APPOINTMENT FOR VIEWING

Get listing

•       Greet “Good morning!” and inquire politely about the property for sale/lease.

•       Tell the owner that we at KingDavid Realty have clients who are looking for properties for rent/sale, and if we can offer their property, our clients might be interested.

•       Get complete information about the property and the capacity to sell/lease-out of the owner/representative.

–      Price? Size? Features and Amenities of the property?

–      Is the seller sole owner? Is the seller married? Corporation? Co-owner? Representative? Etc.

•       Set up an appointment to meet and take pictures of the property.

HOW TO TAKE PICTURES?

Taking pictures of houses

•       Set up your camera settings to low resolution and size, preferrably not more than 500KB but not less than 100KB per picture.

•       Make sure you have the right camera settings for the right lighting conditions. If you don’t know how, then  just put it on full authomatic.

•       Take pictures of the outside: Wide shot, close shot, shot from both sides, the street, the neighboring houses, if possible shot from the back and all sides.

•       Wag tipirin ang pagkuha ng pictures!(Dont’ be stingy in taking pictures!) Keep taking pictures on all possible angles. Shoot from 10 different angles per area of the property highlighting its’ features and references. Shoot from all sides, top, bottom, left, right, upwards, downwards, etc. It is important to give our prospective clients better idea of what we offer.

•       If shooting inside an enclosed space, make sure you capture as much space as you can by moving as far back to the walls when shooting.

•       EXCERCISE: TRY PRACTICE SHOOTING THE CAMERA! SAMPLE PICTURES

•       Upload the pictures through USB or Memory card.
